This Privacy Policy explains how ElsaAi ("ElsaAi," "we," "us," or "our") collects, uses, discloses, and protects information when you use ElsaAi, our AI business assistant for trade businesses (the "Service"). By using the Service, you agree to the practices described in this Policy. Your use of the Service is also governed by our Terms of Service.

1. Information We Collect

We collect the following categories of information:

  • Account information. Contact details you provide when you sign up, such as your name, business name, mobile phone number, and email address.
  • SMS and phone verification information. Mobile phone numbers, verification status, opt-in records, messaging consent, message delivery records, and SMS conversations with ElsaAi.
  • Prompts, messages, and content. The text messages, voice memos, calls, documents, and other content you send to ElsaAi, along with the outputs ElsaAi generates and the actions you approve.
  • Connected service data. Information from the tools you connect to ElsaAi (for example accounting, calendar, CRM, website, or supplier accounts), limited to what is needed to perform the tasks you ask ElsaAi to complete.
  • Usage and device information. Technical data such as log information, device identifiers, and interaction history that helps us operate and improve the Service.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service and its AI capabilities;
  • Understand your prompts and generate relevant outputs, drafts, and proposed actions;
  • Carry out tasks you approve, such as sending messages, preparing documents, or updating connected accounts;
  • Communicate with you about the Service, including support and service notices;
  • Send account verification texts, service notifications, and user-approved business assistant messages by SMS or other messaging channels;
  • Protect the security and integrity of the Service and prevent misuse.

3. AI-Generated Outputs and Actions

ElsaAi is an AI agent. It produces drafts, summaries, and proposed actions based on your prompts and connected data. AI outputs may be inaccurate or incomplete, and ElsaAi asks for your approval before taking actions that send communications, move money, or change your connected accounts. You are responsible for reviewing outputs and approving actions before they take effect. We may process prompts and outputs to operate and improve the Service, consistent with this Policy.

4. Messaging and SMS Interactions

ElsaAi communicates with you by SMS for account verification, service notifications, support, and business assistant messages you request or approve. ElsaAi may also send SMS messages to your customers or contacts only when you direct ElsaAi to do so and represent that you have permission to contact them.

Message frequency varies based on your account activity, prompts, connected services, and the tasks you ask ElsaAi to perform. Message and data rates may apply. You can opt out of ElsaAi SMS messages by replying STOP. You can request help by replying HELP or contacting support@elsaai.com.

We process mobile phone numbers, opt-in data, messaging consent, and SMS content to provide the Service, verify accounts, send service communications, respond to support requests, maintain security, and keep records of consent and message delivery.

5. Third-Party Services and Integrations

When you connect a third-party service to ElsaAi, we access and process data from that service only to perform the tasks you request. Your use of those third-party services is governed by their own terms and privacy policies. We are not responsible for the privacy practices of third parties, and we encourage you to review their policies before connecting an account.

6. How We Share Information

We do not sell your personal information. We may share information:

  • With service providers and subprocessors who help us operate the Service, under confidentiality and data-protection obligations;
  • With the third-party services you connect, only as needed to complete the tasks you approve;
  • When required by law, legal process, or to protect the rights, safety, and security of ElsaAi, our users, or the public;
  • In connection with a merger, acquisition, or sale of assets, subject to this Policy.

SMS non-sharing notice. Mobile phone numbers, SMS opt-in data, and messaging consent are not shared, sold, rented, or provided to third parties or affiliates for marketing or promotional purposes. This restriction applies even when other information may be shared with service providers to operate the Service or when disclosure is required by law.

7. Data Retention

We retain information for as long as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or export your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at support@elsaai.com. We will respond consistent with applicable law.

9. Security

We use administrative, technical, and organizational measures designed to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please help protect your account by keeping your credentials and connected accounts secure.

10. Children's Privacy

The Service is intended for business use by adults. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, contact us at support@elsaai.com and we will take appropriate steps to delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will provide additional notice where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
